Customer Service Platform “myPlasser Portal” at Plasser & Theurer, Export von Bahnbaumaschinen, Gesellschaft m.b.H. (in short: P&T)

Field of Application
1.
P&T provides a web-based Customer Service Platform (myPlasser Portal). The following provisions shall apply to the use of such Customer Service Platform.

The use of the Customer Service Platform shall be exclusively limited to persons authorized to do so by P&T and/or admin users authorized by P&T, and who possess the login data provided by P&T and/or by authorized admin users to use such platform, so called Users. Users shall use the Customer Service Platform as well as the information, downloads, and/or forums, etc. provided therein solely in accordance with the following Terms of Use.
Purpose

The Customer Service Platform is used in various customer service business processes, such as field service assignments and the handling of warranty claims. The Customer Service Platform includes various functional modules, overviews, forms, information pages and communication tools. Upon registration, the User is granted a simple, non-transferable right to use the Customer Service Platform.

The User acknowledges that the information on the Customer Service Platform is used exclusively for the above-mentioned purposes. In particular, the User undertakes to complete any forms (e.g., inquiry forms) or perform other functional processes provided exclusively themselves and to use them solely for their own purposes. The use of teaching and learning materials for commercial purposes is not permitted.
Access to the Customer Service Platform

Registration by P&T and/or an authorized admin user, who will then provide the User with the login data, is required to use such platform. The User shall provide the data required for registration accurately. Upon User registration and transmission of the login data by P&T, the User and P&T enter into a contract that contains these Terms of Use.

Any suspicion of misuse of login data must be reported to the administrator immediately.

If an employee stops working for a service partner, CPP (Certified Plasser Partner), or customer who has access to the Customer Service Platform, the respective admin user must immediately deactivate that access and notify P&T.
Use of the Customer Service Platform

The User shall provide, at their own expense and risk, the technical requirements needed to use the Customer Service Platform (terminal device, internet connection). The User undertakes to use the latest antivirus software, activate an appropriate firewall, and ensure that their actions do not result in the Customer Service Platform being infected with viruses or any other malicious software (malware).

The User is obligated to use the Customer Service Platform appropriately and not to alter, delete, suppress, or render data unusable without authorization, nor to use it in any manner other than its intended purpose. The creation, use, or storage of content containing elements that are defamatory, offensive, threatening, obscene, racist, or that disparage humanity or religion, or that otherwise violate public decency, fundamental democratic values, or legal provisions, is prohibited, as is referring to such content through links or the provision of other Internet addresses. Likewise, posts and content that damage the reputation of P&T, the Customer Service Platform, and/or Users must be refrained from.

The copyright, trademark, and other property rights of third parties must be respected and the principles of citation must be observed.

Any breach of these obligations must be reported to the administrator immediately. The administrator of the Customer Service Platform is also authorized to remove any content that violates the provisions of these Terms of Use.

When the User logs in to the Customer Service Platform, the time of the last/most recent login is recorded in the backend, which is accessible to P&T administrators. Currently, there is no historical record of all login times throughout the entire period of use. However, P&T reserves the right to document the entire usage history in the future.
Intellectual property
13.
The User acknowledges that P&T and/or the respective copyright holder is the sole owner of all trademark rights, copyrights, rights of use, and other intellectual property rights associated with the data and images provided, as well as all texts, images, graphics, audio, animations, videos, trademarks, brand names, and other material used. The User further acknowledges that they are only granted the right — which may be revoked at any time — to use the data and images provided solely for the execution of various customer service processes. Use of, or, as the case may be, the provision of such platform shall not constitute a license for the use of intellectual property of P&T or, as the case may be, of third parties.

Users are responsible for the legality of all content they make available on the Customer Service Platform and ensure that they observe copyright and personal rights. Users who make their own content available on the Customer Service Platform expressly agree that this content may be used by P&T within the scope of these Terms of Use.
Exclusion of Liability and Warranty
15.
P&T provides no guarantee for the availability, completeness, correctness, and topicality of the information provided, for a specific usability of such information, or for the uninterrupted and error-free functioning of the Customer Service Platform.
16.
P&T shall only be liable for damage caused to the hardware or software used by the Users as a result of grossly negligent and wilful breaches of obligations by P&T. This includes any damage resulting accidentally or as a consequence of downloading or using the downloaded files. P&T is not liable for the loss of data.
17.
P&T indemnifies and holds itself harmless for any damage caused by Users and in the event of claims against P&T by third parties. This also applies to the costs of any legal prosecution.
Confidentiality
18.
The User shall keep their login data and information provided by the Customer Service Platform confidential and shall not disclose such data or make it available to third parties.
Exclusion
19.
If the User engages in activities that conflict with existing rights or the purpose of the Customer Service Platform, P&T may revoke the User's authorization at any time without giving reasons, prohibit the User from using the Customer Service Platform in the future, and take legal action against Users who act unlawfully.

Administrators are available for all questions and feedback relating to the Customer Service Platform and can be contacted at support@myplasser.com.

Various resources (video tutorials, PDF guides) are available to Users in the “News & Info” and “Support” menu sections to assist them in using the Customer Service Platform. These resources provide guidance on the most common ways to use the Customer Service Platform and are continuously updated.
Changes to the Terms of Use
22.
P&T reserves the right to amend or supplement the Terms of Use at any time.
Place of Jurisdiction and Applicable Law
23.
Any legal disputes arising in connection with the Customer Service Platform shall exclusively be governed by Austrian law to the exclusion of the conflict of laws rules and shall exclusively be settled by the competent court having jurisdiction over the subject matter and P&T.
Declaration of Consent
24.
The User declares that they are aware of the above Terms of Use and agrees to them.
